When you book with Sunwing Vacations Inc./Vacances Sunwing Inc. doing business as WestJet Vacations Québec or any of its affiliates for whom Sunwing Vacations Inc. is acting as an agent hereunder (hereafter “WestJet Vacations Québec”, “we”, “our” or “us”), the following Terms and Conditions become part of your contract.
To the extent any travel products and/or services are booked through your travel agent or WestJet Vacations Québec, you agree that these Terms and Conditions apply to all transactions. Please ensure that you have read and understood these Terms and Conditions before booking your vacation because making a booking constitutes your acceptance of these Terms and Conditions.
Non-refundable deposits are required to hold a reservation and will vary by product. Please take note of the deposit requirement prior to confirming your booking. ** Up to and including departure and thereafter.

The non-refundable amount to be paid will be advised at the time of booking and is available on your invoice once your booking has been made. Portions of your vacation may be non-refundable such as excursions and attractions, transfers, flights, accommodation options, and room upgrades. We reserve the right to charge any additional change or cancellation fees charged by a supplier. Please note that all departure taxes and travel related fees are non-refundable.
Name corrections and name changes
A valid name correction or name change includes one of the following:
a legal name change,
a married name change,
a typo in the name made by either the customer or agent,
a missing name detail such as a middle name.
Applicable fees for name corrections or name changes are as follows:
21 days or more before departure, a $25 fee on the booking applies per change***.
20 to 8 days before departure, a $50 fee on the booking applies per change***.
7 days or less before departure, any change is considered a cancellation and full cancellation fees apply.

Changes including change of date, gateway or destination airport and hotel or room category
21 days or more before departure, the price for the selected product at the time of the change applies + $100 change fee per person. The change fee will be waived if the price for the new selected product is higher.
20 days or less before travel commences and thereafter, any change is considered a cancellation and full cancellation fees apply.
Changes to room occupancy
Changes to hotel room occupancy are considered a cancellation and rebooking by our hotel suppliers; therefore, pricing at the time of the occupancy change will apply to all occupants of the room and may incur a change fee of $100 per person. If an occupant in a room cancels, that person will be subject to cancellation fees. An additional occupant to the room will be subject to system pricing at that time. In both cases, remaining room occupants will be subject to new pricing as follows: If the new price per person is lower, existing occupants will be refunded the difference less the change fee. If the new price per person is higher, existing occupants will have to pay the difference and the change fee will be waived. If you are traveling as part of a group booking, different policies and terms and conditions may apply. Please see your group contract for details as those terms will apply to your booking.
If you are travelling on another airline other than Sunwing Airlines, different policies and terms and conditions may apply.
Name change policy/guidelines: Name changes are considered cancellations = 100% non-refundable. Name corrections are subject to a fee of $100 per person.
They may also be considered cancellations. Please request name changes with WestJet Vacations Québec.
WestJet Vacations Québec makes every effort to ensure the accuracy of the information in these Terms and Conditions and to the best of our knowledge, all information is accurate at the time of publication. We try to ensure that all prices on this website are accurate, however, mistakes do happen and we reserve the right to refuse to accept and/or cancel and refund any bookings purchased at any price posted in error. Updates are published on our website when new information is made available, however, we cannot be responsible for any inaccuracies or omissions by any third-party publications or postings. This information is provided only as a guideline and should be verified directly with other available sources. We reserve the right to make changes to these Terms and Conditions at any time, and any changes to these Terms and Conditions will be effective immediately after being posted on our website.
Prices quoted on this website are in Canadian Dollars and are based on fixed costs at the time of posting. Prices are based on a variety of factors including, but not limited to, fuel costs, rates of exchange and other factors. Should these costs increase, we reserve the right to increase the price of any of our vacation packages and products. In the event that any such increase is more than 7% (unless it’s the result of an increase in government tax), you will be entitled to cancel your travel arrangements and receive a full refund in the original form of payment. Efforts will be made to advise you of any price increase at least 15 days prior to your departure date. All price increases may reflect administrative costs incurred. For competitive reasons, we reserve the right to deny a price match guarantee. We set our prices based on our costs, as well as anticipated demand. We constantly review our prices throughout the season based on availability and demand, and we reserve the right to increase or decrease our prices accordingly. Unless otherwise noted, the price of your vacation package includes round-trip airfare, hotel accommodations, meals as described and one (1) round-trip transfer in destination to and from the airport and hotel as selected. The features and the bonus features that are provided by each hotel (whether on a complimentary basis or not) are clearly described in each hotel’s description. All hotel information provided on this website has been provided to WestJet Vacations Québec by the applicable supplier. WestJet Vacations Québec may contract accommodations directly with the hotels or through a third-party supplier. Any features that are temporarily unavailable or that have been permanently withdrawn for whatever reason do not have any cash value and are, therefore, non-refundable. These features can be changed by, the hotel or WestJet Vacations Québec with or without prior notice.
All costs for entry and exit fees, entry visas, passports, health certificates and items of a personal nature (e.g. laundry and dry cleaning, some à la carte restaurants, meals and alcoholic beverages not mentioned in itineraries, casino, medical services, excursions, telephone calls, WIFI access, spa and salon services, safe, mini-bar, tips, onboard gratuities and certain baggage charges, etc.) are not included in the price of your vacation package.
From time to time, we advertise promotional offers, that may be limited to selected departure gateways, destinations or hotels. All of these promotions are time sensitive and, therefore, have a start and end date. They are not combinable with any other promotion that may be advertised and available at the same time. All published prices and promotions advertised and offered by WestJet Vacations Québec have limited availability and may be withdrawn at any time, with or without prior notice.
Ages for children and infants’ fares vary for each airline and hotel. We recommend that you consult with your travel agent or the WestJet Vacations Québec Sales Centre to determine the respective rate(s) for your children and infants. Upon check-in, hotels may require proof of age for reservations made that include a “child price”. If a child’s age does not comply with the hotel’s policy (e.g. 2-12 years on the last day of travel), the hotel may charge the child an adult rate and require immediate payment for the difference between the child rate and the adult rate. If you require a crib at the hotel, it must be requested at the time of booking and, if available, the hotel may charge a small fee. Infants under two years of age on the last day of travel fly free of charge, but still require a reservation in order to appear on the passenger manifest. One infant may travel per adult, however the infant travelling free of charge is not allocated a seat on the airplane If an infant turns two while travelling, the now-two-year-old must occupy a seat on the aircraft for the return flight and you will be responsible to pay the price of the aircraft seat. Under certain circumstances, air tickets may be sold to unaccompanied minors; for full information on Sunwing Airlines’ unaccompanied minors’ policy, please visit the special assistance page.
Any hotel preferences such as dining times, room locations, bed preferences, etc. that are not associated with special needs must be requested at the time of booking or requested on My Booking Portal. While we will attempt to accommodate special requests, we will not be held responsible if your requests can’t be fulfilled.
We strongly recommend that you purchase our Worry Free Cancellation Waiver or Manulife Travel Insurance + Worry Free by WestJet Vacations Québec at the time of booking or other sufficient traveller’s insurance to provide you with security and protection against unexpected events that could disrupt your vacation plans. A non-refundable deposit/non-refundable amount is due at the time of booking. The minimum payment will vary depending on your travel dates and supplier agreements. You will be notified when your deposits and/or final payments are due at the time of booking. If you are travelling as part of a group, different deposit and payment policies may apply. Please see your group contract for details. Failure to adhere to the payment schedule outlined in your booking terms and conditions may result in the cancellation of your booking and any applicable fees. Please refer to schedule of deposits, change fees and cancellation policies. If you selected a payment plan option with Uplift Canada Services ULC (“Uplift”), then Uplift’s payment terms and the terms and conditions of your Loan Agreement and any other agreement with Uplift will apply. WestJet Vacations Québec accepts MasterCard, Visa and American Express credit cards as forms of payment. If your payment is made using American Express, Visa or MasterCard, please be advised that “WestJet Vacations Québec” will appear as the vendor on your credit card statement. Your authorization to use your credit card number to pay for travel services provided by WestJet Vacations Québec indicates your acceptance of our Terms and Conditions. By providing your travel agent or WestJet Vacations Québec with authorization to use your credit card to pay for your WestJet Vacations Québec travel services, you are confirming that you will pay the total amount charged for those services to the card issuer according to your cardholder agreement. If your payment is made through your travel agent, your travel agent becomes equally responsible for the payment of your reservations, and it is the duty of the travel agent to keep a copy of your authorization on file. In the event the credit card holder is not one of the passengers travelling, a Third-Party Credit Card verification process will be completed including a Third-Party Credit Card form with two pieces of government issued identification. Reservations are not guaranteed until your credit card check is complete and payment has been received.
WestJet Vacations Québec reserves the right to request additional information from passengers and/or the cardholder at any time after a purchase has been made, including at check-in, in order to verify the information provided at the time of purchase. In the event that a customer is unable to provide this additional information with accuracy, WestJet Vacations Québec further reserves the right to cancel the reservation in the event that fraud, theft, or dishonesty are suspected.
Travel vouchers and/or credits may be applied to a future WestJet Vacations Québec vacation package where Sunwing Airlines is the air carrier, unless otherwise specified. Vouchers and credits must be submitted at the time of booking. Restrictions may apply. Please refer to the terms and conditions stated on the travel voucher for more details. WestJet dollars can be used towards payment of the base price of an eligible WestJet Vacations Quebec package. WestJet dollars cannot be applied against taxes, fees or charges and can only be used for new bookings. For WestJet Vacations Quebec bookings, WestJet dollars are not applicable to hotel only or group travel bookings. Minimum redemption rules apply and may vary. Any refunds determined to be owing will be provided in the original form of payment unless otherwise advised.
Refunds won’t be provided for any unused travel services and the price or value of the unused travel services cannot be exchanged. The day of departure is excluded when calculating cancellation or change fees. All cancellation fees will be calculated on the total amount of products and services purchased. We strongly encourage that you purchase travel insurance to provide you with coverage for unexpected developments that may cause you to either cancel your vacation entirely or interrupt your vacation unexpectedly. These travel insurance plans can only be purchased at the time of booking. Refunds are not issued for bookings cancelled by you or WestJet Vacations Québec resulting from an act of God or an Event of Force Majeure.
Your WestJet Vacations Québec travel documents won’t be released until we have received your full and final payment as per these Terms and Conditions. Electronic tickets and vouchers will be available for printing 28 days or less prior to your departure date and will not be issued prior to the 28 days. Visit Manage My Booking to access your tickets and other important information. Your airline ticket(s) will contain conditions as well as the terms of carriage. Please read these conditions carefully as they are important. Tickets issued are subject to the applicable terms and conditions in addition to the carrier’s tariff, the rules under the Warsaw or Montreal Conventions (as applicable), and any other applicable laws and regulations.
We recommend that you visit your destination’s tourism board website or consulate for information on relevant laws, customs and required documentation. In many destinations, English and French are not the official languages and if you encounter a situation where you require translation services, our WestJet Vacations Québec local Representatives cannot provide professional translation services due to legal liability implications. Please contact the Canadian Consulate office for assistance in hiring a qualified professional translator. Customers with special needs who will require special services or assistance while travelling, including accessible rooms and/or private transfers, must contact the WestJet Vacations Québec Special Services Department at the time of booking or at least 10 business days prior to departure. In order to ensure that you are properly assisted, we request that you advise us of any and all specific needs that you may have. This will help us to ensure that the proper travel arrangements are made so you can focus on enjoying your vacation. The hotel or WestJet Vacations Québec cannot be held responsible for non-fulfillment of any special needs request whatsoever. Please note that additional costs may be applicable for some or all of the services requested. Please note that some foreign destinations may not define or provide for wheelchair access in the same fashion that we are accustomed to at home, and that some hotels may not be able to guarantee or confirm adapted or accessible rooms prior to departure. It is your responsibility to make sure you have the correct documents required for travel to your destination and for your return to Canada. We will assume no responsibility whatsoever for passenger(s) denied carriage by the airline or refused entry into any country. Canadian citizens must carry a valid Canadian passport. Canadian citizens can contact the Government of Canada for more information on passports and required documentation. Non-Canadian citizens should contact the relative Tourist Board or Consular Office prior to booking https://www.vacanceswestjetquebec.com/en/travel-requirements. Please note that several countries now require that your passport be valid for up to six months after your return date in order to be allowed entry into the country. If your passport is damaged in any way, you could be denied boarding and you will be responsible for all costs associated with a new passport and a replacement vacation.
Customs and/or immigration officials can deny a person or persons, whether they are residents or visitors, entry (or re-entry) into their country at their own discretion. A previous criminal record could be an obstacle in international travel. We cannot be held responsible for denied entry under any circumstances.
Check with your travel agent and/or the airline you’re travelling on for baggage allowance and weight restrictions. Lost or damaged baggage is the responsibility of the airline, which may have limited liability. We strongly recommend that you purchase Manulife Travel Insurance + Worry Free by WestJet Vacations Québec to be compensated for your loss of, or damage to, your baggage. If your luggage is damaged, lost or delayed, please contact the airline representative before leaving the airport. Failure to do so may invalidate any potential claim you may have against the airline.
All flight times, airlines, types of aircraft and itineraries are subject to change with or without prior notice. Your airline reserves the right to substitute alternate airlines or aircraft types and to add en route stops or make any other operational changes at our discretion, with or without prior notice. Operational changes can occur which may result in the need to reschedule or cancel flights. In the event that we need to advise you of any such changes prior to your departure from Canada, we require that either you or your travel agent provide us with your contact telephone number. It is your responsibility to contact the airline shown on your ticket within 24 hours prior to departure to reconfirm your flight time and it is highly recommended to reconfirm again prior to leaving for the airport. In the event of a flight delay related to weather, traffic or an Event of Force Majeure (as defined below), it may not be possible for the airline to provide meals and/or accommodations. We do not accept responsibility for lost wages, missed vacation time or any other additional expenses incurred as a result of changes in flight times. We try to arrange flight times to allow for ample time to transfer to your cruise pier, making it unlikely that you’ll miss your cruise departure unless there’s a long delay due to weather or other problems. If you do miss your cruise departure due to a flight delay, we’ll do our best to make alternate arrangements. No refunds or other compensation will be issued for missed cruise departures caused by any flight delay or missed flight connection. Please note that the cruise line reserves the right to charge full cancellation fees if you fail to embark. We strongly encourage that you purchase travel insurance to provide you with coverage for any unexpected delays or issues.
Please note that in standard travel industry terminology, the term “direct flight” refers to a flight that will transport the passengers from their point of origin to their final destination without the journey involving a change of aircraft. However, the term may still be used to describe a journey that involves a stop, provided the same aircraft continues the journey after the stop. Passengers on board a direct flight are not required to claim checked baggage and re-check said baggage during a stop in the journey and are usually not required to be de-planed during any stop(s). A flight from the point of origin to the final destination that does not involve any stops en route is referred to as a “non-stop” flight.
All connecting flight reservations are made at your own risk. You assume the cost of any loss if a change to your Sunwing Airlines flight requires you to change your connecting flight(s). We cannot be held liable for any damages or additional fees incurred due to a missed flight connection for whatever reason.
If you are denied boarding, your flight is cancelled or delayed for at least two hours, or your baggage is lost or damaged, you may be entitled to certain standards of treatment and compensation under the Air Passenger Protection Regulations. For flights operated by Sunwing Airlines, check-in commences three hours prior to departure and closes 60 minutes prior to departure. For all other airlines, please contact the airline for specific check-in times. You are required to have obtained your boarding pass and presented all checked baggage before the cut off/check-in deadline. For security reasons, you will be denied boarding if you have not checked in within that time. You must be at the boarding gate by the boarding time noted on your boarding pass. Failure to respect the deadline may result in the reassignment of any pre-reserved seats and the cancellation of your reservation (refunds will not be provided). Please note that we will not provide refunds or compensation for any unused seating upgrades or provide any compensation as a result of a passenger being denied boarding. Should you be denied travel, it is your responsibility to make alternate arrangements. It is your responsibility to arrive at the airport on time and to proceed to the correct departure gate by the time specified on your boarding pass. We cannot be held responsible if you miss your flight by failing to comply with these requirements.
You may use web or kiosk check-in with your airline on behalf of the travellers on your booking, or travellers may check-in individually, to choose their seats, obtain their electronic boarding pass, check-in any baggage and purchase any extra baggage allowance. It is your responsibility to inform the travellers on your booking that their personal information may be visible to other travellers on your booking as they check-in.
Please be advised that, while conditions may not always be the same as those at home (particularly in regards to food, electricity, water supplies and private toilet facilities), our staff, agents and/or suppliers have inspected all of the hotels described on our website to ensure acceptable standards. As the health and well-being of guests and staff are a hotel’s top priority, precautionary actions may be taken by the hotel during your stay (including, but not limited to, compliance with all governmental agencies or entities’ directives, orders, regulations, guidelines and/or advisories, use of social distancing and/or masks, temperature screening, limited/reduced amenities, immediate disclosure to the hotel of symptoms and/or knowledge of possible infection, personal hygiene, self-isolating and quarantining and any other orders or directives issued by the service provider or any applicable agencies or entities of any federal, provincial, state or local governments) to prevent exposure to illnesses, viruses and/or diseases. You must follow all such health and safety measures. We strongly recommend that you contact the hotel directly for the most up-to-date information on health and safety protocols. All hotels undergo routine maintenance and renovation both in the low and high seasons. At brand-new hotels, some facilities may not be fully functional and landscaping and other finishing touches may be ongoing during your stay. If we are advised that significant work at your hotel will be in progress during your stay or that any major facilities won’t be available, we will try to advise you prior to your departure. Topless sunbathers may frequent some resorts and resorts have no control of topless sunbathing. The hotel cannot accept responsibility for the behaviour of other guests/groups or the withdrawal of services or facilities due to cultural and political events or holidays. These circumstances are usually regulated by local governments and as such are beyond the control of either WestJet Vacations Québec or the hotel. Most hotels offer international satellite TV which differs from Canadian satellite TV. The number of English channels will vary by country and by hotel. Ocean view rooms can consist of a full or partial view of the ocean and can differ by property. Not all rooms designated as “ocean view” will offer a full or direct view of the ocean. Minimum age restrictions can vary per hotel and per destination and we recommend that you enquire about any restrictions at the time of booking.
Star ratings are based on a number of factors including, but not limited to, our opinion regarding location, amenities, and facilities relative to the general standards of the destination; as well as feedback from customers, staff and suppliers. These ratings may differ from other published ratings. Our hotel star ratings are not a representation or promise of any particular feature or amenity.
The check-in time for most hotels is 3:00 p.m. and check-out time can be as early as 11:00 a.m., regardless of your arrival or departure times. Please refer to your hotel accommodation voucher for actual check-in and check-out times and dates as they may differ from your departure and return date. Check-in policies differ by hotel and will vary. Many hotels offer hospitality areas if you are waiting for your room or your return transfer to the airport; however, availability is based on the discretion of the hotel. If you want to make arrangements for a late check-out and baggage storage, you must make arrangements directly with the hotel and charges may apply. We do not accept responsibility for any inconvenience or loss arising from these types of arrangements. Some hotels may require you to leave a credit card imprint or cash deposit upon check-in to provide security for miscellaneous charges such as telephone calls.
The accommodation voucher or electronic confirmation number provided constitutes as the sole contract between, the hotels/resorts and you (the customer). The hotels and resorts depicted on this website will not be held liable for any act, omission or event during the time you are not staying at their establishments. Neither WestJet Vacations Québec or these hotels are responsible for payment of any refund for unused accommodations or meals as a result of late arrival or non-arrival by customer(s), regardless of the cause.
If the accommodations you reserved are not available for any reason, we reserve the right to substitute a similar hotel room or stateroom category. This section does not apply to a change in hotel that is a major change, as referred to in the section “WestJet Vacations Québec Responsibility”; or to a change of hotel that occurs for reasons beyond our reasonable control. We have taken great care in selecting the travel suppliers used and featured on this website. Your WestJet Vacations Québec representatives, supported by NexusTours, are available 24/7 to offer assistance and liaise with our suppliers to resolve any problems or answer any questions you may have during your stay. We highly recommend that you download the WestJet Vacations Québec App before departure to be able to easily contact your WestJet Vacations Québec representatives. Any problem must be brought to the travel supplier’s attention or your WestJet Vacations Québec representative’s attention immediately so that they can work to ensure that you have an enjoyable vacation and that enough time is given to solve the problem. Please note that your failure to report your concerns at the time of occurrence may preclude your right to a claim. Should you remain dissatisfied with the service provided and wish to provide further feedback, please send your written comments to your travel agent and/or Support at WestJet Vacations Québec within 30 days of your return. Any claim received more than 30 days after your return will not be accepted. WestJet Vacations Québecwill not be liable for any claims exceeding the amount paid for the services with respect to which you are claiming. We are unable to accept responsibility for any assurances or guarantees provided by travel agents, hotel employees or suppliers of any kind.
As we make arrangements with airlines, hotels, transfer companies, excursion providers and other independent suppliers to provide you with the services you have purchased, such suppliers may take enhanced health and safety measures to prevent exposure to illnesses, viruses and/or diseases. These measures may include but are not limited to, compliance with all governmental agencies or entities’ directives, orders, regulations, guidelines and/or advisories, use of social distancing and/or masks, temperature screening, reduced amenities, immediate disclosure to the supplier of symptoms and/or knowledge of possible infection, personal hygiene, self-isolating and quarantining and any other orders or directives issued by the service provider or any applicable agencies or entities of any federal, provincial, state or local governments. You must follow all such health and safety measures. We strongly recommend that you contact such suppliers directly for the most up-to-date information.
Any optional activity (including tours, excursions or activities) that you choose to do on vacation, may pose a risk of personal injury, loss or damage to you and/or your personal possessions. By participating, you agree to assume the entire risk of any and all such injury, loss or damage which you may suffer during or arising out of your participation in the said optional tour, excursion or activity. We make arrangements with transfer operators, coach companies, destination excursion operators and other independent contractors (hereinafter referred to as the “service providers”) to provide services in connection with optional tours, excursions or activities. We exercise great care in choosing our service providers, but we do not have control over them and, therefore, cannot accept responsibility for, nor can be held liable for, any acts or omissions or negligence of the service providers, their employees, servants, agents, subcontractors or unrelated third parties. Some of these service providers may not be agents or employees of WestJet Vacations Québec notwithstanding their use of any signage or clothing which may contain the name “WestJet Vacations Québec” or other related trade names or logos. These optional tours, excursions and activities are subject to conditions and limitations imposed by the said service providers as well as the laws of the country in which they operate. You hereby release, discharge and indemnify WestJet Vacations Québec from any and all liability or claims of any nature arising out of or in relation to any loss, damage, injury (including death) or illness whether physical (including, but not limited to, contracting food-borne illnesses, viruses, diseases, etc.), or mental, resulting from any delay, substitution of equipment, or any act, omission or negligence of service providers, their employees, servants, agents, subcontractors or unrelated third parties resulting from or arising out of any of the optional tours, excursions or activities in which you voluntarily participate and/or any optional tour, excursion or activity arranged at your specific request and/or at your cost, whether booked prior to your departure from Canada or in destination, and you agree to accept all risks associated therewith. You hereby expressly waive any claim against WestJet Vacations Québec for any cause arising out of or related to the actions, omissions, or negligence of any person or party other than WestJet Vacations Québec. You may be required to sign a written release in destination forever releasing, discharging and indemnifying WestJet Vacations Québec from any and all claims of any nature arising out of or related to any such optional tours, excursions or activities made, and agree to assume all risks associated with them. You understand and agree that all optional tours, excursions and activities are non-refundable and non-transferable.
We strongly recommend that you check the list of the Government of Canada’s travel advisories before finalizing your travel plans. While we do our best to keep you updated on any relevant changes to local laws, travel documentation requirements and any travel advisories issued, we cannot guarantee the accuracy of the information provided. It is your responsibility to be aware of and prepared for all legal, documentary, health and other requirements for your intended travel, including, but not limited to, mandatory face covering requirements for air travellers. We assume no responsibility whatsoever for passenger(s) being denied carriage by the airline or refused entry into any country and no refund will be issued. Standards of living and conditions with respect to the provision of utilities, sanitary services and the grading of services such as hotel accommodations vary considerably from one country to another. In other countries, the uninterrupted supply of water and electricity, local health conditions, levels of security and standards of food and beverages may differ from those enjoyed at home. In tropical climates, insects are commonly found inside and outside of any hotel. Injury (including death), illness (including, but not limited to, contracting food-borne illnesses, viruses, diseases, etc.) or inconvenience resulting from the services provided or not provided in destination are outside our reasonable control and we accept no responsibility for such injury, illness or inconvenience. You must assume all risks and sole responsibility for any injury (including death), illness (including, but not limited to, contracting food-borne illnesses, viruses, diseases, etc.) or inconvenience while travelling or upon return. It is your responsibility to adhere to the customs, rules and laws of the country that you’re visiting. Should you behave in a manner that’s threatening to WestJet Vacations Québec or hotel employees and/or other customers, WestJet Vacations Québec, or thehotel has the right to refuse service or expel you from the hotel. If this occurs, you are responsible for all costs resulting from said expulsion and no refund will be issued for any unused portion of your vacation. The airline also reserves the right to deny check-in or boarding or off-load belligerent or unruly passengers from its flights, including making intermediate stops to off-load such passengers to the control of local police authorities if necessary. In the event of such off-loading, deplaned passengers will not receive any refund for unused travel services (including, but not limited to, air, hotel, transportation, etc.) and will be liable for arranging and paying for their own onward air travel, and liable to the airline for any cost incurred resulting from inappropriate behaviour including, but not limited to, additional landing and fuel charges.
On your behalf, we make arrangements with airlines, hotels, transfer companies and other independent suppliers to provide you with the services you have purchased. We exercise due care in selecting these suppliers and pay particular attention to their reputation and reliability. However, we do not control these suppliers and thus, we cannot be held responsible for their performance or lack thereof. WestJet Vacations Québecas the tour operator and/or our agents will not issue any refunds and shall not be held responsible for any claims, losses, damages, costs or expenses arising out of personal injury or death, loss, damage or delay of baggage or other property, delay, loss of enjoyment, inconvenience, upset, disappointment, distress or frustration whether physical, emotional or mental, resulting from or arising out of any of the following:
i. Any act or omission (including, but not limited to, inability or failure to provide services and/or products) by any customer, supplier or third party including, but not limited to, the airlines, transportation companies, coach tour operators, car rental organizations, excursion providers, hotel/resort properties, or anyone for whom such suppliers or third parties may be in law responsible;
ii. An act of God or Event of Force Majeure;
iii. Equipment failure
iv. Sickness/illness (including, but not limited to, contracting food-borne illnesses, viruses, diseases, etc.), family emergencies, theft or any other circumstance affecting you beyond our direct control;
v. Failure of the passenger to obtain the necessary documentation or meet the required health regulations in order to complete their travel arrangements;
vi. Failure of the passenger to follow instructions including, but not limited to, airport departure times, baggage handling and check-in time frame stipulated by the airline on the day of departure whether due to missed connections, adverse weather conditions, mechanical failures or any other reason whatsoever;
vii. Voluntary participation in an optional tour, excursion or activity;
viii. The need for us to cancel services, change itineraries or substitute accommodations or services, provided that efforts are made to supply comparable services and accommodations available; or
ix. Cancellation of an optional tour, excursion or activity While every effort has been undertaken to ensure accuracy, any photographs, artist’s renderings and written descriptions appearing on this website are representational only and are not a guarantee that everything at the resorts or in the destinations will be exactly as depicted.
WestJet Vacations Québec and/or our suppliers do not assume liability for any loss, damage or injury of any nature in whole or in part resulting from an act of God or any other force majeure condition including without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, flood, explosion, water or power shortages or failures, storms or hurricanes, riots or civil commotions or disturbances and any other acts of similar nature, sabotage, arrests, strikes, boycotts, picketing, lockouts or other labour disruptions, inability or failure of a third party service provider to provide services and/or products, restraints of rulers or peoples, expropriations, acts of terrorism, public enemies, war, invasion, insurrection, national emergency, epidemics, pandemics, quarantine restrictions, government health advisories or warnings or alerts of any kind or nature, government seizures, any laws, rules, proclamations, regulations, orders, declarations, advisories, actions, interruptions or requirements of or interference by any government or governmental agency thereof, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, any other unforeseen circumstances in any country in the world or any other cause or causes of any similar nature that impacts negatively on or hampers its ability to fulfill any of its contractual conditions (all of the foregoing being herein referred to as an “Event of Force Majeure”). In the event that any of these conditions apply, WestJet Vacations Québec shall be excused, discharged or released from its performance to the extent such performance is so limited or prevented, without liability of any kind and WestJet Vacations Québec non-performance shall not be deemed a breach of these Terms and Conditions. In such case, WestJet Vacations Québec’s obligations hereunder shall be extended to the extent of any delay resulting from the Event of Force Majeure and a full refund will not be granted.
Our liability for any loss, damage or injury – whether to property, physical or mental, arising from our own acts, omissions or negligence – is limited to the amount you paid for the services with respect to which you are claiming.
The customer agrees to indemnify and save harmless WestJet Vacations Québec and its parent, subsidiaries and affiliates, against any liability, actions (including legal fees), claims, losses, costs and damages, which WestJet Vacations Québec may incur, sustain or pay arising out of or in connection with the customer’s acts or omissions, in relation to any incident alleged to have occurred in destination and/or in relation to services provided by WestJet Vacations Québec.
WestJet Vacations Québec is committed to protecting your privacy and collects, uses, discloses and retains your personal information in accordance with its Privacy Policy which is incorporated herein by reference. You agree that you have read our Privacy Policy and consent to our use of your personal information in accordance with the terms and conditions set out in such policy. These Terms and Conditions are binding upon all customers included in the itinerary and such customer’s family, dependants, estate, heirs, successors and legal personal representatives.
Your contract with WestJet Vacations Québec is governed by and is to be construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Further, any claim or action arising out of or relating to the negligence acts or omissions of WestJet Vacations Québec shall be filed only in the courts of Ontario and you agree to attorn to the exclusive jurisdiction of such courts. All claims in connection with the acts or omissions of a third-party supplier shall only be brought against such third-party and be filed only in the courts of the jurisdiction where the act or omission of such third party occurred and you agree to attorn to the exclusive jurisdiction of such courts. The governing laws of the jurisdiction where the act or omission of the third party occurred shall apply to such claims.
If any term or condition or any portion hereof is held invalid or unenforceable, the remaining portions of these Terms and Conditions will remain in full force and effect, and, if possible, the portion(s) found unenforceable will be construed in a manner consistent with the remaining portions.
By making a reservation to purchase a vacation product from WestJet Vacations Québec, you, the customer/passenger, hereby acknowledge that you have read and accept the Terms and Conditions contained herein. Furthermore, when making a reservation for a WestJet Vacations Québec product on www.vacanceswestjetquebec.com , you agree that you are solely responsible for such reservation. You also confirm that as the booking or instructing passenger, you have the legal capacity and authority to book travel services on behalf of yourself and of other persons named in the invoice and itinerary. It is you who will keep your travel agent or WestJet Vacations Québec informed of any changes to your travel plans or contact information.
These Terms and Conditions are valid for bookings made between May 14, 2024 and October 31, 2025.
